Walden Estate Sale Policies

A RESOLUTION FORMALLY ADOPTING THE LONG STANDING POLICY OF THE WALDEN ASSOCIATION REGARDING SALES OF PERSONAL PROPERTY, COMMONLY REFERRED TO AS ESTATE SALES, WITHIN WALDEN.

            WHEREAS,  The Walden Association, under the provisions of Article XVI, Section 8 of The Master Warranty Deed and Declaration of Covenants and Restrictions, has the right to adopt and promulgate reasonable rules and regulations; and

            WHEREAS, in order to preserve the general welfare, security and health of the residents of Walden, The Walden Association has determined it to be in the best interest of the residents to formally adopt the long standing policy of The Walden Association regarding sales of personal property, commonly referred to as Estate Sales.         

            NOW, THEREFORE, BE IT RESOLVED that:

Section 1:   Personal property liquidation sales of all or the majority of a household's personal property, an estate sale, shall only be permitted on the condition of:

  1. the death of a property owner or spouse; or
  2. a property owner moving out of their living unit in Walden.

Section 2:   Said sale shall only be conducted once for either of the permitted conditions, and the unit owner must notify the president of their condominium or homeowner association thirty (30) days prior to the sale.

Section 3No such sale will be allowed unless the unit owner arranges and pays for any additional costs of security to control parking and assure that streets are open to emergency vehicles.

Section 4:  Sales shall be limited to two (2) days unless compelling circumstances, as determined by the President of the Association, justify a third day.  Hours of said sale shall be limited to 9:00 a.m. - 5 p.m.

Section 5The Association President shall have the responsibility to investigate and act upon requests and monitor the sale to make certain that all requirements are met.  The Association President will also notify the Security Committee Chairperson and inform them of the details of the sale.
